Syllabus by the Court. 1. An order denying a motion to modify a memorandum decision to allow the plaintiffs to retain the benefits of an alleged
fraudulent transaction involving two oil and gas leases and two mineral deeds, and to procure the cancellation of the mineral
deeds only, is held, for reasons stated in the opinion, not appealable as affecting a substantial right in the action, nor
does the order in effect determine the action and prevent a judgment from which an appeal might be taken. Nor does such order
involve the merits of the action or part thereof. Section 28-2702, subsections 1 and 5, NDRC 1943.
